Website Terms of Use

Applies to: the public marketing website at bluecollarvoice.ai (the “Site”) and any public demo experiences we make available through the Site (“Demos”).

IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER. PLEASE READ SECTION 17 CAREFULLY.

1) Who we are

The Site is operated by Blue Collar Voice LLC (“Blue Collar Voice,” “we,” “us”).

2) What these Terms cover (and what they do not)

These Terms cover your use of:

  • the Site (our public marketing website), and
  • Demos made available through the Site (for example, scheduling a Zoom demo, a phone demo, or a chat demo).

These Terms do not apply to the Blue Collar Voice customer service/product.

Public Demos are for evaluation and are not the same as being a registered user of our product.

If you become a registered user of our product (including during a private beta) or a paying customer, your use of that product/service will be governed by a separate agreement (for example, a master services agreement) and separate service terms/privacy notices.

These Terms also do not apply to any customer portal, onboarding portal, or other authenticated product experience, even if linked from the Site.

3) Accepting these Terms

By accessing or using the Site or Demos, you agree to these Terms.

If you do not agree, do not use the Site or Demos.

If you are using the Site or Demos on behalf of a company, you represent that you have authority to accept these Terms for that company.

4) Who the Site is for

  • The Site and Demos are intended for U.S.-based businesses and business representatives evaluating Blue Collar Voice.
  • You must be at least 18 years old to use the Site or Demos.
  • The Site and Demos are for business evaluation. They are not intended for personal, family, or household use.

5) Changes to the Site or these Terms

  • We may change, suspend, or stop the Site (or any feature) at any time.
  • We may update these Terms by posting an updated version on the Site.
  • If you keep using the Site after an update, you accept the updated Terms.

6) Privacy

Our Privacy Policy explains how we collect and use information when you use the Site and Demos. It is part of these Terms.

7) What you can do on the Site

We give you a limited, revocable, non-transferable permission to access and use the Site for:

  • learning about Blue Collar Voice, and
  • evaluating whether you want to talk with us or request a demo.

8) What you cannot do

Please do not:

  • break the law while using the Site or Demos
  • try to access the Site in ways you are not authorized to (including probing, scanning, or testing vulnerabilities)
  • interfere with the Site (including bots, scraping, denial-of-service, or heavy automated traffic)
  • reverse engineer or attempt to extract source code from the Site (except to the extent this restriction is not allowed by law)
  • impersonate another person or company
  • upload or send malware or harmful code
  • use the Site to send unsolicited messages or spam
  • attempt to access or extract non-public prompts, system instructions, or underlying models through the Site or Demos

9) Demos, chat, and AI interactions

The Site may include ways to interact with us or our technology, such as:

  • scheduling a demo (for example, through a Zoom scheduling page),
  • trying a public AI demo by phone, and/or
  • using a chat feature (which may be automated, human-assisted, or a combination) to get information, schedule a demo, or handle vendor inquiries.

Third-party processing. Our AI voice and chat features may be powered by third-party technology providers (including AI and communications providers). If you use a Demo, your interactions may be processed by those providers to generate responses and operate the Demo (as described in our Privacy Policy).

Some Demo experiences may be provided through third-party services. Your use of those services may also be governed by their terms and policies.

A) Demos are for evaluation only

Demos are provided for evaluation and informational purposes only.

B) AI can be wrong (and is not trained for trade safety)

If you interact with an AI Demo or chat feature:

  • it may be inaccurate, incomplete, or outdated
  • it may not work consistently
  • it is not professional advice (legal, safety, financial, or otherwise)
  • it is not trained or intended to provide technical trade safety guidance (including electrical, gas, plumbing, HVAC, or similar work)
  • you must not rely on it for jobsite safety, code compliance, permits, inspections, or safety instructions
  • you should not rely on it for decisions that could affect safety, compliance, finances, or emergency response

C) No binding offers, discounts, or contracts (AI cannot commit us)

The Site and Demos are for informational purposes. They cannot make binding offers, discounts, commitments, or contracts on behalf of Blue Collar Voice.

Any statement that appears to promise pricing, discounts, timelines, features, or other commitments—whether made by an AI Demo, chat feature, or otherwise—is not binding. Only a written agreement signed by an authorized Blue Collar Voice representative can create a binding commitment.

D) Not for emergencies

The Site and any Demo are not an emergency service and are not 911.

If you have an emergency, call 911 or your local emergency number.

E) Don’t share sensitive information

Do not share:

  • payment card numbers or security codes
  • government IDs (like SSNs)
  • medical information
  • other sensitive personal data
  • confidential customer lists or trade secrets

If you choose to call or chat with a Demo, you understand that:

  • Blue Collar Voice and our service providers will process your communication to operate the Demo, respond to you, prevent abuse, and troubleshoot issues.
  • We and/or our providers may create transcripts of what you say or type.
  • We and/or our providers may also record Demo calls or chats in some cases (for example, for quality assurance, troubleshooting, and security).

If a Demo interaction will be recorded and/or transcribed, we will provide notice at the start of the interaction (for example, an automated announcement at the start of a call, a message in the chat interface, or another clear notice). By initiating or continuing the call or chat after that notice, you expressly consent to recording and/or transcription (as described in the notice). If you do not consent, do not use the Demo.

G) Carrier charges

If you use a phone “tel:” link or call a Demo number, your carrier may charge you. You are responsible for any fees.

H) Your Demo inputs (permission to use)

If you provide content through a Demo (for example, voice audio, what you say, what you type, or other information you submit) (“Demo Inputs”):

  • you retain any rights you have in your Demo Inputs, and
  • you grant Blue Collar Voice a non-exclusive, royalty-free permission to use and process your Demo Inputs in accordance with our Privacy Policy to operate, secure, troubleshoot, evaluate, and improve the Site and Demos, and to develop and improve our technology.

This includes creating transcripts or similar outputs needed to run and evaluate the Demo.

Do not submit Demo Inputs that you do not have the right to share.

The Site may link to, or integrate with, third-party services and analytics providers (for example, Zoom scheduling pages and Google Analytics). Those services are not controlled by us.

Your use of third-party services is governed by their own terms and policies, and we are not responsible for them.

11) Intellectual property

  • The Site (including text, graphics, logos, and overall design) is owned by Blue Collar Voice or our licensors and is protected by intellectual property laws.
  • You may not copy, modify, distribute, sell, or lease any part of the Site unless we give you written permission.

12) Feedback and submissions

If you send us ideas, suggestions, or feedback:

  • you understand we may use it without restriction, and
  • you are not expecting payment or confidentiality for that feedback.

If you need confidentiality, ask us about an NDA before sharing.

13) Accessibility

We aim to make the Site accessible to as many people as possible.

If you have difficulty accessing the Site or need an accommodation, contact us at [email protected] and tell us what you need. We will try to help.

14) Disclaimers

The Site and Demos are provided “as is” and “as available.”

To the fullest extent permitted by law:

  • we do not make warranties or promises about accuracy, reliability, uptime, or fitness for a particular purpose
  • we do not promise the Site or Demos will be uninterrupted, secure, or error-free

15) Limitation of liability

To the fullest extent permitted by law:

  • Blue Collar Voice will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) related to your use of the Site or Demos.
  • Blue Collar Voice’s total liability for any claim related to the Site, Demos, or these Terms will not exceed $100.

Some states do not allow certain limitations. If those laws apply to you, some of these limits may not apply.

Nothing in these Terms limits liability for things that cannot be limited by law.

16) Indemnity

To the extent permitted by law, if your use of the Site or Demos causes third-party claims or losses for us (for example, because you violated these Terms or the law), you agree to defend and indemnify Blue Collar Voice from those claims and losses.

17) Dispute resolution and arbitration

This section is important. It affects how disputes are resolved.

A) First: informal resolution

Before filing a claim, you agree to contact us at [email protected] and include:

  • your name and contact info
  • what happened
  • what you want us to do to resolve it

We’ll try in good faith to resolve the dispute informally within 30 days.

B) Binding arbitration

If we can’t resolve the dispute informally, you and Blue Collar Voice agree to resolve any dispute arising out of or related to these Terms, the Site, or the Demos through binding arbitration:

  • Administrator: American Arbitration Association (AAA)
  • Rules: AAA rules will apply (AAA Consumer Arbitration Rules for individuals using the Site for personal purposes; AAA Commercial Arbitration Rules for business-to-business disputes), unless a different set of rules is required by law for your dispute
  • Location: Remote by video/phone, or Alameda County, California, unless applicable law requires a different location
  • Arbitrator: one arbitrator
  • Fees: For individual consumer disputes, Blue Collar Voice will pay AAA filing and arbitrator fees to the extent required by the applicable AAA consumer rules (and will not seek fees from you beyond what those rules allow)

C) Exceptions

Either party may:

  • bring an individual claim in small claims court (if eligible), or
  • seek injunctive relief in court to stop misuse of intellectual property, unauthorized access, or security-related harm.

D) No class actions

You and Blue Collar Voice agree to bring disputes only on an individual basis.

No class actions, class arbitrations, or representative actions.

E) Opt-out (optional)

You may opt out of arbitration by emailing [email protected] within 30 days of your first use of the Site, with the subject line “Arbitration Opt-Out,” your name, and a clear statement that you want to opt out.

If you opt out, disputes will be resolved in state or federal courts located in Alameda County, California, and you and Blue Collar Voice consent to that venue (unless applicable law requires otherwise).

18) Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

19) Miscellaneous

Severability. If any part of these Terms is found unenforceable, the rest will remain in effect.

Entire agreement. These Terms (together with the Privacy Policy) are the entire agreement between you and Blue Collar Voice about the Site and Demos, and they replace any prior agreements on that topic.
